Terms of Sale
These terms apply to every sale. They are written to be read, and they say the same thing as the rest of the site.
- 1. Who we are
- Easton Gallery ("we", "us") sells works of art online through easton-gallery.com. Our contact address for all purposes is info@easton-gallery.com. Our legal name and place of registration appear on every invoice.
- 2. Prices
- All prices are in United States dollars and include packing. They exclude shipping, insurance in transit, and any sales tax, duty or VAT, each of which is shown separately on the invoice. We may change a listed price at any time before you have paid; a price agreed on an invoice is fixed.
- 3. Ordering and payment
- A sale is made when we issue an invoice and you pay it. Until then a work remains for sale to anyone, unless we have agreed a hold in writing. Payment is by card or bank transfer, in full, unless we have agreed trade terms in writing. Bank charges on transfers are the buyer's.
- 4. Title and risk
- Title to a work passes to you when we have received payment in full. Risk passes to you on delivery. Between dispatch and delivery the work is insured by us for the purchase price.
- 5. Delivery
- We dispatch within three working days of payment unless we have told you otherwise. Transit times given on the site are estimates. Delivery requires a signature. Shipping, duties and returns are governed by our Shipping & Returns page, which forms part of these terms.
- 6. Returns
- You may return any work bought unseen within fourteen days of delivery for a full refund of the purchase price, on the conditions set out on the Shipping & Returns page. This does not affect any rights you have under the law of the place where you live.
- 7. Descriptions
- Every work is described on its page and in What You Are Buying, which forms part of these terms. We describe works as contemporary, hand-painted, decorative and unattributed. We make no statement, and give no warranty, as to the age, authorship or provenance of any work, and no such statement is to be inferred from any inscription, seal, signature, style or mounting. Measurements are approximate to within about a centimeter. Colors on screen are indicative.
- 8. If a work is not as described
- If a work is materially not as described, tell us within fourteen days of delivery and we will collect it at our expense and refund you in full. This is the extent of our liability for any description.
- 9. Liability
- Our total liability in connection with any sale is limited to the price you paid for the work. We are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law.
- 10. Cancellation by us
- If, after you have paid, we find that a work is damaged, has been sold elsewhere in error, or cannot be described as we thought, we may cancel the sale and refund you in full. That is your only remedy in that case.
- 11. Governing law
- These terms are governed by the laws of the United States and of the state named on your invoice, and any dispute will be brought in the courts of that state, without prejudice to any consumer rights you have where you live.
- 12. Changes
- We may revise these terms. The version on the site at the date of your invoice is the one that applies to your purchase.
